Zoning Code Amendment CA 24-03 (Battery Energy Storage System Facilities Ordinance), an Ordinance of the County of Orange, State of California, adding section 7-9-122 and amending section 7-9-134.6 of the Codified Ordinances of the County of Orange.

PROPOSAL

Recommend adoption of Zoning Code Amendment CA 24-03 to include development standards for Battery Energy Storage System (BESS) facilities located within unincorporated areas of the County of Orange. The intent of BESS facility regulations is to advance and protect public health, safety, and welfare by establishing regulations for the installation and use of BESS facilities within unincorporated Orange County.

PREVIOUS ACTIONSOn September 10, 2025, the Orange County Planning Commission held a public meeting regarding the proposed Zoning Code Amendment CA 24-03 and voted to recommend the Board of Supervisors make the appropriate findings under the California Environmental Quality Act (CEQA) and adopt Zoning Code Amendment CA 24-03.
ENVIRONMENTAL DOCUMENTATIONThe proposed Zoning Code Amendment CA 24-03 is exempt (Common Sense Exemption) from the provisions of CEQA pursuant to CEQA Guidelines Section 15061 (b) (3) since there is no possibility that the addition of regulations for BESS Facilities to the Zoning Code, may have a significant effect on the environment. Proposed future BESS facilities will be reviewed for CEQA compliance at the time a Use Permit application is submitted to determine the appropriate level of environmental review.

Rancho Mission Viejo requests approval of "A" Vesting Tentative Tract Map 19349 (VTTM 19349) to subdivide 121.27 acres into 53 total lots: 20 numbered lots for Urban Activity Center development, a maintenance area, and monument signage; 33 lettered lots for open space/slopes. The map comprises the eastern portion of Subarea 3.14 in Planning Area 3 of the Ranch Plan Planned Community.

ENVIRONMENTAL DOCUMENTATION

The proposed project is covered by previous CEQA documentation, which includes Final Program EIR 589, which was certified on November 8, 2004; Addendum 1.0, approved on July 26, 2006; Addendum 1.1, approved on February 24, 2011; the Planning Area 2 Addendum, approved on March 27, 2013; and Addendum 3.1 approved on February 25, 2015. This finding is appropriate and complies with the intent of CEQA pursuant to the 2020 Orange County Local CEQA Procedures Manual, Section 13.1 for projects where a previous environmental document (i.e. Program EIR 589) is already in place. Further CEQA evaluation and clearances are not required for proposed “A” VTTM 19349.
